National Summary

Communicable diseases are a major workplace issue. Employers must juggle liability issues, applicable federal and state regulations, preventative measures, productivity losses, and employee concerns and fears. One in six large employers has (or has had) an employee with acquired immunodeficiency syndrome (AIDS) or its precursor, asymptomatic human immunodeficiency virus (HIV). Other ailments in the workplace range from common colds to tuberculosis. There are several laws that restrict the action an employer may take with regard to an individual with a disability or serious health condition, including the Americans with Disabilities Act of 1990 (ADA) , the Federal Rehabilitation Act of 1973 , the Family and Medical Leave Act of 1993 (FMLA) , and the Occupational Safety and Health Act (OSH Act)
